A UK prospect list labels every row business, then treats all email addresses alike. That hides an important distinction: a limited company, sole trader, and some partnerships do not necessarily fall into the same electronic-marketing category. A professional-looking website or business-domain address does not establish the subscriber's legal type.

Use an entity-type decision aid before approving UK outreach. It should route uncertain cases to review, preserve evidence, and keep the subscriber question separate from the treatment of named individuals' personal data. This is an operational research aid, not legal advice.

Read the current UK distinction carefully

The ICO's B2B guidance distinguishes corporate subscribers from individual subscribers, including sole traders and certain partnerships. It says electronic-mail consent rules differ, while personal-data obligations can still apply to business contacts. Corporate messages must not conceal the sender and must provide a valid opt-out address. The page is under review following the Data (Use and Access) Act, so check current guidance and obtain qualified review before relying on a classification.

Do not translate this distinction into “all B2B email is exempt”. Other communication channels have their own rules, and a corporate subscriber classification does not resolve every data-protection or marketing question.

Build a decision aid with an uncertainty branch

Start with the recipient organization and the subscriber relevant to the proposed channel. Use suitable authoritative evidence of legal form where available. Record the source and date, not just a label supplied by a list vendor.

  • Confirmed corporate subscriber: route to the corporate electronic-mail review, including personal-data, identity, opt-out, and other applicable requirements.

  • Confirmed individual subscriber, such as a sole trader: route to the relevant consent or qualifying-exception review.

  • Partnership: verify the actual legal type and jurisdiction; do not assume every partnership is treated alike.

  • Uncertain subscriber type: use the cautious individual-subscriber treatment described by the ICO while the question is resolved.

  • Different channel: stop using this email-specific branch and review the relevant channel rules.

The decision aid should not issue a send authorization on its own. It supplies a verified input to the broader assessment.

A fictional three-record review

Synthetic prospect U11 trades under a business name but is confirmed to be a sole trader. U12 is a limited company with a named procurement employee. U13 uses a professional domain, but the legal form remains unclear.

U11 enters the individual-subscriber route. U12 enters the corporate-subscriber route, while the employee's personal-data handling remains separately assessed. U13 stays held under the cautious treatment rather than being promoted to corporate because its website looks established.

A second reviewer should be able to reproduce each classification from the recorded evidence. A company-name suffix copied from an unverified directory may need corroboration. Do not infer legal form from business size, turnover, branding, or the seniority of the contact.

Check changes and mismatched identities

An organization can change structure, and a contact address may belong to a different entity from the brand shown on its website. Record the entity the evidence actually describes. A parent company's incorporation does not automatically establish the subscriber status of every franchisee or independent operator using its branding.

Review when the entity changes, a merger occurs, a new address is added, or the planned channel changes. Do not treat an old classification as permanent. Keep unresolved identity and subscriber questions visible to the person approving the message.

Use synthetic examples to test whether your CRM routing preserves all branches, especially unknown and partnership cases. A required boolean field labeled business cannot represent this decision reliably. Add a reviewed classification and status through an approved schema process instead of forcing uncertainty into yes.

The completed artifact should identify the entity, evidence, subscriber classification, reviewer, proposed channel, applicable guidance version, and remaining conditions. Its value is that it prevents a broad sales label from replacing a specific legal-context review. When evidence is insufficient, the correct next step is to verify or pause, not to assume the least restrictive category.
